12th man dispute goes to court today

Court date today

 

A court date has been set for today in Brazos County. It's unclear who will be in court today representing the Seahawks.

The organization's top brass is in Detroit, where the team is preparing for Super Bowl XL on Sunday night. Team management has been unavailable for comment.

 

While the timing might seem like grandstanding, Moore said A&M was given little choice.

 

"Normally when these kind of things come up, it is a very private thing between the two parties," Moore said. "We were hopeful that that would happen and they would see the light and contact us.

 

"Now, given the largeness of the Super Bowl and all that goes with it, if we just sit back and do nothing it puts us on the back foot because we are not really protecting our trademark. So from my standpoint, we have to do this."

 

The Seahawks as an organization has not responded to media questions about the alleged infringement, but individuals have indicated the 12th Man is not being used by the team but by its fans.

 

Moore isn't buying that claim.

 

"There's a lot of evidence to the contrary," Moore said. "If that were the case, then we certainly would not be doing this."

 

Moore said the school has dealt with such infringements in the past from the Chicago Bears and Buffalo Bills, but the organizations stopped using the 12th Man when notified by A&M.

 

 

Seahawks noncommittal

 

What has miffed A&M and its lawyers has been the Seahawks' unwillingness to even discuss the matter.

"There are enough things that they've done that mimic things that we do down here that go well beyond just retiring the No. 12," Moore said. "Certainly they can do that and they did that. More power to them. And certainly you can't own the No. 12 because that's on athletic spamshirts everywhere.

 

"But when you go to the extent of creating 12th Man merchandise and having 12th Man clubs, then in our opinion you have stepped into our territory."

 

The school first began using the 12th Man moniker in 1922, and since then it has become one of the best traditions in all of college football.

 

So the Aggies are willing to play hardball on the NFL's grandest stage this week.
