A Hennepin County judge ruled there wasn't probable cause to determine a crime was committed by Culpepper, one of four Minnesota Vikings accused of misdemeanor lewd conduct during the cruise last fall on a suburban lake. Culpepper has since been traded to the Miami Dolphins. Judge Kevin Burke denied a motion to dismiss charges against running back Moe Williams. The other two players charged, cornerback Fred Smoot and tackle Bryant McKinnie, weren't part of Tuesday's ruling. Their next hearings were scheduled for Thursday. I would rather he stayed with the Vikes, however, even without the Loveboat scandal it seems there was no getting along between Daunte and the Vikes new coach. Culpepper, who was accused of touching a dancer's buttocks, testified that he spent the cruise playing a dice game in the back of a boat and rejected offers from several women. Williams, accused of touching a dancer's breast, testified that a woman danced near him but he never touched her. In explaining his ruling, Burke wrote Culpepper's version of events would clear him if true, and since the prosecutor offered nothing to rebut it, he found no probable cause that a crime was committed. The difference with Williams, the judge wrote, was that his story wouldn't necessarily exonerate him because a crew member may have seen the dance and been offended. From espn.com So, if they DID have eyewitnesses to what C-Pep was accused of, he would still be on trial. Do you see the difference? I wasn't debating whether Daunte was guilty or not, only that what he was accused of was a crime. The judge didn't rule that what he was accused of was not criminal. We're not talking about Culpepper being found not guilty, which is the ruling when there is not enough evidence to convict beyond a shadow of a doubt. We're not even talking about Culpepper being found innocent, which is the ruling for complete vindication of charges after a trial. Fact is, we're talking about the charges against Culpepper being thrown out altogether. There simply wasn't any evidence for the case to go to trial. "Since no evidence was presented to refute this testimony" (the Judge's own words) Judge Kevin Burke outright dismissed the charges against Culpepper.
