Levine said Foley was shot twice in the back of the left thigh and once on the outside of the left thigh. He also has what may be a gunshot wound to his right hand. A warning shot and NOW two rounds from behind? The investigation seems to be more focused on Drunk Driving charges. They say Foley was over .08 , but won't be specific. What about this bozo cop? Was he in an unmarked civilian car? I for one would never pull over, drunk or not, for someone that says they are a cop! A warning shot in a residential neighborhood???? I am in El Centro, on the other side of the hill, but keep up with all my contacts with the team and the city daily. There are some very BAD things arising out of this whole thing. YES... Foley was drunk, I think that was probably clear to many of us from the get go. What is WIERD is the way this whole thing went down. Hundreds of DUI arrests occure every day without being shot from behind, TWICE! I have already talked about the warnig shot and officer safety issues in another thread. AND... after reading these following articles 1 2 Search Warrant To this point, it is obvious that the Law Enforcement Sysytem is trying to maintain the focus on Foley and his culpability in this whole thing. There has been no indication that "they" are casting any question into the actions of the cop, who according to one of the above articles, LOST HIS FATHER TO A DRUNK DRIVER! This in itself possibly accounts for and "over exuberant' and maybe overly emotional reaction to this encounter with Foley. My feeling is that they are trying to "cover their bases". I don't like ANY of this story from either side! If Foley was breaking the law, he should be accountable! If this cop pushed a situation WAY beyond the point that he needed to, he too should be reprimanded. All we know is the cop's side, Foley has refused to speak with officers to date. Knowing what I know about the system, he is doing the smart thing. No weapons were found accessible to Foley, the kid cop seemed to panic (in my opinion) by firing what I have counted in various accountings as up to TEN rounds, including a WARNING SHOT This in itself is the wierdest fact. I don't know of ANY Law Enforcement Entity in todays litigation/liability paraniod world that condones warning shots. There are a few maritime exceptions in dealing with VESSELS, not individuals. I know we teach that if you are going to shoot, you shoot to stop the threat, PERIOD! When the threat is gone, you stop shooting.
