If they don't can't they just use that money in free agency and maybe pick up an average player that may end up being better than a pick anyway? The Patriots have some high price players and "extra" cap money does not hurt them too much. I understand that the union would throw a fit if cap money was taken away but this just means the punishment was nowhere near as severe as people think if they don't understand or take into account the cap money. I felt from the beginning that losing sy 10% of their cap for a couple of years would be an appropriate punishment.
