News: The Denver Post reports that the NFL has set a Nov. 5 hearing for Travis Henry to appeal his third positive test for Josh Gordon. "I know nothing," Henry said. "I really don't know any dates for anything." Henry faces a year-long suspension if the league upholds its decision. However, Henry has also taken the case to a federal court, saying the NFL didn't adhere to its testing procedures.

 

Analysis: At least now Henry's Fantasy owners know they'll have his services through Week 9, after which the league will probably uphold its decision and he'll probably have to begin his year-long suspension. Then again, if Henry wins his case against the NFL, he'll continue to play regardless of the league's decision. Henry's owners should expect the worst, though, and have Selvin Young ready for that seemingly fateful day when they lose Henry for the season. The Broncos host the Steelers in Week 7, giving Henry an unfavorable matchup, but he remains a must-start in all leagues since he's run for over 100 yards in five of his last seven games.

If Travis Henry's defense team has its way on a motion filed Wednesday, the NFL could suffer a rare court setback and might face possible legal sanctions.

 

An attorney representing the Broncos running back filed a motion in U.S. District Court stating the NFL violated a temporary restraining order. The order was to prevent the league from testing a second Henry urine sample after the first one came back positive for a "negligible amount" of Josh Gordon.

 

Attorney Steve Zissou's motion asks that the case be returned to the Supreme Court of the State of New York from the federal court so the judge whose order Zissou says was violated can determine sanctions against the league.

 

"We are confident we will prevail," said Zissou when reached for comment after the motion was electronically filed in the Eastern District of New York on Wednesday.

 

Henry, 28, has rushed 549 yards on 119 carries for Denver. This is his first season with the Broncos. He signed a five-year deal in April with $12 million in bonuses after being released by the Tennessee Titans.

 

Because Henry was in phase two of the league's substance abuse program, a positive test would trigger at least a year's suspension.

 

Henry's case revolves around him seeking to have his specialist present when a "B" sample of urine was tested in order to confirm the "A" test result.

 

According to Wednesday's filing, Henry provided a sample Aug. 27, then was notified "on or about Sept. 4" that he had tested positive. Henry sought the restraining order to ensure his specialist was present for the second test, but according to the filing, that did not happen.

 

Zissou's motion states the case never belonged in the federal court and the violation of the temporary restraining order is further reason to have it sent back to the state court. The NFL requested the case be moved to federal court, contending it involves national labor laws because of an agreement between the league and the players union regarding the substance abuse program.

 

Until these legal issues are resolved, which could take three weeks or more, it appears Henry will continue to play for the Broncos, who are counting on him to lead their rushing attack.

 

Henry has said he will not talk about the case under the advice of his attorneys and the NFL. Last week, he said, "I know nothing about what's going on."

This seems ludicrous but I think allowing an expert there for a second testing should be allowed.

 

An expert is allowed. The only exception that the CBA has regarding an expert being present is that the expert not be affiliated with a testing lab. Henry's was, and therefore by CBA contract he was excluded.

Hey BB, what seems to be the local thought on this saga? Do people care at this point or just want it to be over with? Also, anything coming from his teammates suggesting that this is a distraction?

There is virtually no one talking about the Donkeys in town. It's all Rockies, all the time. I think people here are football savvy enough to know that DEN is fielding yet another medocre team that will finish near or above .500 and then fade quickly if it happens to make the playoffs. As stupid as that may sound to fans in ATL or CLE or AZ that people really don't give a rat's ass about a team that could win the division or make the playoffs, here it's the same old song - make the playoffs and then get the sh!t kicked out of us when we have to play games that really count. Shanahan has about used up the bank he earned with 2 SBs with almost everyone but owner Pat Bowlen.

 

This year's version is particularly hard to watch because it has literally no chance of stopping a team that commits itself to running the ball with great regularity. At least the DEN teams that got blown out in the earlier SBs played a D that was damn fun to watch hit people. This product is nauseating and almost unwatchable. I've seen Boys' Club teams that tackle better. I've never seen less interest in football in this town than what is going on right now. People just don't care about the Donkeys.

It sucks when your run D sucks, looks like swiss cheese and the commish is making jokes about it, doesn't it? It really does sting a little. It's nice that the Chiefs have passed the torch to one of our hated rivals :D

While that may be true, as bad as DEN is this year, they still figure to finish ahead of KC.
