Wow... I didn't expect him to be next on the list of NFL players arrested this off-season.

And drunk drivers never cease to amaze me with the stupidity they show...

 

Not to defend drunk drivers, but cops in this state have been going way overboard and routinely arresting folks way below the legal limit, to the point of settling out of court in lieu of a lawsuit in certain instances where people have been wrongfully arrested. I'm hearing that Lofa blew a 0.15 so that doesn't seem to be the case for him.

There is zero excuse or reasoning that is suffice with me, but that's probably because I had a close friend that was killed by a drunk driver... If you've been boozing, don't get behind the freaking wheel.

This isn't the thread to discuss this; but if cops are going to enforce a zero tolerance policy; then do it and let it be known. Don't fool people into thinking they aren't legally drunk if they have had 2 beers and drive back home.

That's right. That is easy to forget. Hopefully next time he'll call a cab.

He had more than two beers.

I mentioned this wasn't the proper thread to discuss DUI's in general as I'm definitely not trying to defend a guy if he was at a 0.15 BAC. I felt your all-encompassing statement about any "drunk" driver being stupid flew in the face of some things I've seen happen in my neck of the woods lately.

 

I've had 2 buddies arrested for DUIs when they had BACs below 0.04 in the last 1/2 year. Here is one arrest that made some news, where a guy apparently had 1/2 glass of wine at a wedding reception. :

Management, Risk Management Division, paid $7,000.00 to settle a false arrest claim

filed against the State Patrol.

 

On July 8, 2006, Rock Island resident Ivan Terry Vance was stopped while driving by

Washington State Patrol Trooper Ronald C. Cantwell (Badge #360). The traffic stop

took place in Douglas County on State Route 28 near Hydro Park. Mr. Vance

voluntarily submitted to field sobriety tests, including a portable breath test

which measured a .003---essentially a zero reading and far under the State’s legal

limit of .08. Despite the result Trooper Cantwell arrested Mr. Vance and took him

to the East Wenatchee Police station for further tests. Trooper Cantwell called in

a Drug Recognition Evaluator (DRE) who examined Mr. Vance and concluded he was not

under the influence and was able to operate a motor vehicle safely. Despite that

information Trooper Cantwell charged Mr. Vance with the crime of Driving Under the

Influence. Trooper Cantwell’s report of the arrest made no mention of the DRE’s

conclusion that Mr. Vance was not under the influence.

 

 

Outraged by the decision, Mr. Vance filed a tort claim with the State to recover his

legal expenses and compensation for his stress and anguish. The State has now paid

Mr. Vance $7,000 for this claim, although it stopped short of admitting any

wrongdoing as part of the settlement

 

Trooper Cantwell is an 11 year veteran of the State Patrol. In 2004 he arrested

more drivers for DUI than any other Trooper in the State except for one. Simply

being arrested for DUI does not necessarily mean the person was actually convicted

of the charge. In May of 2005 the local Wenatchee newspaper, The Wenatchee World,

wrote an article touting Trooper Cantwell’s “success.”

 

Like I said, if law enforcement is going to pursue a zero tolerance policy with harsh consequences, at the very least they should let people know what rules they are playing by.

Yes, frankly, youth is an excuse for stupidity. He could have killed someone, but so could any number of individuals on a Saturday night leaving bars all over the planet in their vehicles. Not to mention the hundreds of thousands (millions?) of NFL fans who leave football stadiums every Sunday (or bars, or parties, etc..). And just because he could have killed someone doesn't make this offense anywhere near the realm of ACTUALLY killing someone.

 

I'm not excusing Lofa Tatupu's behavior, and of course it's absolutely a lapse in judgment for him to be caught in this situation. However, I would be much more concerned if this was the second or third time he has had an issue like this.
