(AP)—A prosecutor says the state trials of Michael Vick and three co-defendants on dogfighting charges will be delayed until they are freed from federal prison. Commonwealth’s Attorney Gerald Poindexter says it’s not worth the expense for Surry County to get the men from prisons in different states for trial and escort them back later. Vick and the other defendants face charges of beating or killing dogs, or causing dogs to fight other dogs, and engaging in or promoting dogfighting. He says it's not worth the expense? If Vick loses isn't he responsible for transportation as court costs? The state is saying they can do this later because it's cheaper? Well maybe they will, but something about this reasoning sounds weird. Either way anyone holding on to Vick after he becomes a RFA should rethink it. He pled guilty to conspiracy at the federal level and has been indicted for unlawfully torturing and killing dogs and promoting dogfights at the state level. Vick plead guilty to one felony charge of conspiracy to operate an interstate dogfighting ring, which the court accepted. Has to be, dog fighting itself isn't within Federal jurisdiction. Moreover, the Surrey County prosecutors didn't indict Vick on dogfighting charges--even though Vick admitted to killing dogs in his sworn statement in the federal case--mostly because the local prosecutor is a crooked old coot with a long history of not really bothering to prosecute dogfighters. Finally, Virginia has some extra 'double jeopardy' laws on the books, something like you can't go to trial twice for the same situation. Ergo, Vick will basically skate on the state charges. After dawdling so badly the Feds had to intercede, after dragging his feet every step of the way, and after faling to indict Vick on crimes he swore under oath that he committed, the Surrey County prosecutor was re-elected. In Virginia? lol More likely this will blow over and people will go "poor Vick, he's had enough, we want to see 'Mr Excitement' on the field again" (blah blah ad nauseum). If anything, pressure will be for VA to let him slide.
