Company fires employees over fantasy football

From what I got, all this guy did was get some PM's about FF. If he wasn't actively using his company computer to play, how can he be fired? Gambling is not illegal. That has caveats attached, but casinos allow peole to gamble legally. For all the company knows, he could have been in a casino when they had their league draft! :wacko: Doing it on company time or equipment is against policy. Recieving an unsolicited message or email does not mean he was gambling on company time or equipment.

 

So, if you know someone at Fidelity, and want to get him fired, just send him a FF related email? I think, if the info presented is accurate, this guy has a case against the company. If I were him, I would definitely persue that angle.

 

One more thought... what if it's a free league?

I'm not sure all the details came out in the story. i can only guess based on my experience at a corporate entity. You're right in that you can't get fired for an unsolicited message because then anyone can send messages to employees about pretty much anything inappropriate to get them fired. He would have had to reply.

 

If it was a free league, i don't think he would have been fired. Our company policy does not allow gambling. The amount doesn't matter. So a free league would not be gambling.

 

My guess is that it will be very difficult for this guy to win any kind of a lawsuit. The company has more ammunition than you would think. For example, i'm sure he was going to espn, etc. during the work day. Well, that's using resources unrelated to work. Grounds for termination. If not that, i'm sure there's other things they can ding him for.
