"Death from shrimp dodging" Yep, THAT'S gonna be upheld. WOAHH!!!!!!!!!!! KILLER SHRIMP! DUCK!!!! Unfortunately, while I'm sure it was just an instinctive reaction to something flying at his head, there's a heck of a lot of burden on the defense now to show that it this was just a weird coincidence. And I've eaten at those kind of steak houses before, last I remember, if you didn't want any food tossed your way, they wouldn't do it. And it has nothing to do with coincidence. Plaintiff is going to have to convince a jury, among other things, that the acts of the chef proximately caused the death of the guy.
