Really, a lawsuit here seems unjustified. I mean, how could the Arch file suit against its visitors just because they are a tad overweight? If the photographer didn't get express permission, of course it would make it a lot worse. But I assume the implication of the photo is the woman's weight had something to do with the cables snapping. That is untrue, and therefore I expect could be libelous. She is not a public figure and so I assume she could sue on the gorounds the paper has hurt her reputation in the community?** **All a rank guess on my part, I am no lawyer.
