Were you on the phone? Did you have an expectation of privacy? Were you aware of the recording and not consenting, or wholly unaware? Had you taken steps or precautions to try to secure some privacy? I assumed we were talking "man to man". He left & came back in and confronted me again. After about 5 minutes he said something about "I hope you enjoyed being recorded." or something like that. Were you aware of the recording and not consenting, or wholly unaware? Completely unaware Had you taken steps or precautions to try to secure some privacy? We were standing at the front counter in the showroom. There were no other customers in the shop @ the time. My Asst. Mgr was up front & saw the whole thing go down. yo mama Posted November 21, 2011 Share Posted November 21, 2011 Nope Look, as a practical matter this is probably only going to be relevant if he tries to blackmail or embarrass you with the tape. And at that point you're going to go after him - not for the unauthorized recording - but for slander, libel, defamation, extortion, or whatever it is he's up to. If he doesn't do anything with the tape you're kind of stuck. Because unless you have a copy, you can't even prove that he did in fact record your conversation. Maybe he wants to sue you and will try to use the tape as evidence in a court proceeding - it may or may not be admissible, depending on state law. Guy sounds like a D-bag.
