Azazello1313 Posted April 1, 2008 Share Posted April 1, 2008 Maybe not legal precedent, but you can bet your hairy red ass that the if WalMart caved on this, the very next time they were due a large settlement, that their employees family would be down at the local TV station, and you would have this exact situation all over again. well, sure. that is going to happen either way. and if the facts are more in walmart's favor, ya know, so they don't look like evil arseholes trying to take back money from a brain-dead former employee, they can push their case. my point is, it is totally within their power to make a case-by-case determination on this sort of thing, and it sure seems like they'd be wise to use that discretion here.
