In addition to her health issues (less than 5% survival over 5 years) Stevens is 89, and I heard on NPR about a month ago that Souter has flat out told Stevens that if he doesn't retire, then Souter plans to and go back to Vermont. He hates DC and apparently wants out. Stevens still plays racquetball and apparently feels well. This all certainly bears watching, and i hope the best for Ms. Ginsburg. Ginsberg wanted to stay on the court into her 80's. Her leaving wouldn't do much, except put someone similar but younger in her seat. I have read some of her work...very sloppy. I prefer the prose of Scalia....even though I disagree with his decisions like 60% of the time...for someone who is a strict constructionist...he sure makes a lot of Athenae up.
