*I* wouldn't have a problem with this bill, assuming there was some sort of enforceable guarantee that such firearms wouldn't leave Texas. Perhaps, for example, if the state of Texas were willing to assume any liability for damages caused out of state in connection with guns that were manufactured within the state. I mean, if guns aren't crossing state lines it would never be a problem and Texas would never have to pay. If, however, guns do cross state lines and cause economic harm then its pretty clear they are affecting intrastate commerce.

 

FWIW, the Commerce Clause affects pretty much everything. Ironically, the only recent case I can recall where the Commerce Clause failed to reach the subject at issue was another gun case: United States v. Lopez, 115 S.Ct. 1624 (1995).
