Sure they can, a 0.08 is not required to be illegally impaired, the courts here take the opinion it's one part of a weight of evidence. My buddy who got a DUI on a 0.05 got it dropped to negligent driving; but that still costs thousands of dollars in fines along with increased insurance and classes and what not that need to be attended. Last time I was at Safeco I think I paid $5 for a hot chocolate.. and not some big badass 16 oz er, but a regular paper coffee cup full.
