The cop who wrote my ticket stated I didnt have to appear in court nor did he check the box on my ticket that I had to appear. So I went online to pay my fine and I read my summons is not payable. So I contact the court and find out the cop was wrong and its a mandatory appearance. This is a two hour ride for me. Now per the letter of the law Im guilty and have no problem paying the fine, but why would I have to appear in court for a summons?? Doesnt that seem a little excessive for a simple open container. I was stopped - engine off - in the parking lot waiting to go in to the club. I had four total beers in the car and was on my first one IIRC this is one of those laws that if your keys are locked in the glove compartment, then you're good to go, but if you have them within reach, you're busted. If it were me, I'd believe the court papers over what the cop told me and plan a day in court. You're right...maybe he won't show and you can get off on that technicallity since you are supposed to be allowed to face your accuser. I was like 11 over the speed limit (one of those busy streets that suddenly drop to 35) and the ticket was like 90 bucks. Of course I also had to pay $47 court fee on top of that. Even if I didn't go to court and just paid the ticket or took the class. It just annoys me how retarded some of this crap is. If I go online and pay a fee with my debit card, i still have to pay court fees? Why not just up the cost of the speeding ticket if you want more money. Anyway, I'll stop my blathering / rant. I wouldnt appear at all and just stay put of NJ altogether, but I frequesnt the Stone Pony and the Starland Ballroom - for the life of me I cant figure out why they want me to appear in person. Its not a big deal and Im not embarrased by it. Its just Asbury is apparently real uptight - Im certain multiple people in management and VPs of major companies like to go to events like football and hang out and have a few beers outside the stadium.
