Most courts will not entertain more than one motion for summary judgement and this motion does not address the issues in any meaningful way. Yes the Mavs won, but that does not mean that Cuban has not made a litanny of personell errors. Sure the team of players did well, but the Dallas Mavs as a legal entity are far more than a team of players. With GM's, Coaches, scouts, Public Information and Marketing Departments, Trainers, Secretaries, Janitors, and what not Cuban could be making really bad personell moves, and the motion does not speak to that. Further, his motion does not speak to the financial viability of the team whatsoever. It is true that champion franchises are generally more valuable, but not often enough such that a judge could take judicial notice of this. His motion fails to address a major issue raised in the suit, and so, as a matter of law he will not prevail. In taking the matter at this point in the light most favorable to the non-moving party the Court will have to say their is a genuine issue of material fact since Cuban and his legal team have not addressed that issue at all. In fact, when the Court recieves a responsive pleading it may contain headlines about Cudban paying for $20,000 dollar bottles of champaign, paying for parades, or paying for rings for everyone in the organization. If he used organization funds for these things, rather than his personal funds, even if inadvertently, he may be found to have been in violation of his feduciary obligations to his partner. To qualify as a badass legal document it ought to be one that addresses all the legal issues sufficiently that one wins their case or their point.
