TUNNEL HILL — One of two men who was arrested for DUI on Sunday said they were no more than 20 feet away from one of their yards — and on horseback.

 

Gregory Scott Cooley, 40 of 119 S. Lakeshore Drive, and Jeffery Ray Owen, 42, of 101 S. Lakeshore Drive, bonded out of the Whitfield County Jail Monday morning on $891 cash or a $1,782 property bond with the help of a bail bondsman, a jailer said. They were within a few feet of Owen’s property when they were told to dismount, Cooley said.

 

“We had a few beers earlier in the day while we were watching the (NASCAR) race,” Cooley said. “My son had the horses out, and we just jumped on them to take a little ride before he put them back up. Instead of (the officer) telling us to get off the road, we got arrested.”

 

Cooley said he and Owen want people to know “we weren’t threatening people’s lives running up and down the road in a 3,000-pound car.” He said he heard some of the neighbors were complaining that they were hanging off the horses and were making them “rear up” like in a cowboy movie.

 

“I wouldn’t even know how to make a horse do that,” he said, adding that being arrested is “kind of silly.”

 

Police Chief Roy Brunson said both men were over twice the legal limit for driving, which is .08 blood alcohol content.

 

“The way we look at it, they put themselves in danger, they put other people in the roadway in danger, and the horses, too,” he said. “If they get that horse in front of a car, we’ve got a serious situation.”

 

Brunson was asked if the department had ever made a DUI arrest of someone on horseback.

 

“Not a horse, per se,” he replied, “but we have had DUIs on bicycle.”

In college my wife got pulled over by a fire engine cause she was riding her bicycle drunk as a skunk. The firefighters were adamant they could take her in for DUI. She said she couldn't keep a straight face or take them seriously, and the fire engine ended up escorting her home with lights full on. :wacko:

After their arrest, Owen and Cooley sold their two horses because they say the only reason they had them in the first place was to ride them when they were too drunk to drive.

Can they prove who was actually driving? The horse or the man?

 

 

Flip Wilson, that really is his name, was arrested for DUI about 10 years ago. He took it all the way to the South Dakota Supreme Court and that is exactly the argument that was presented. It was eventually thrown out and he set a precident here. It was quite interesting to follow. It would have been his third DUI if I remember hence the fight.
